These Terms and Conditions govern your use of the Oxart mobile application and website, collectively referred to as the “Platform”, which is operated by Oxart (the “Service Provider”). By accessing or using the Platform, you agree to be legally bound by these terms. If you do not agree to any part of these terms, you must immediately discontinue use of the Platform.

Oxart functions as an online marketplace designed to facilitate the sale and purchase of handmade art and craft products. It supports both business-to-consumer (B2C) and consumer-to-consumer (C2C) interactions. The Platform allows users to register as either buyers or sellers, and the Service Provider acts solely as a facilitator. It is important to understand that the Service Provider is not a party to the actual sale transaction between users, and it does not guarantee the quality, legality, accuracy, or timely delivery of products unless the products are explicitly sold directly by Oxart.

To access certain services on the Platform, users are required to create a user account. The individual creating the account is responsible for maintaining the security and confidentiality of their login credentials. All activities conducted under the account are the responsibility of the account holder. The user agrees to provide complete, accurate, and current information during the registration process and to keep this information updated as needed. Use of the Platform is restricted to individuals who are at least 18 years old or those who have obtained the permission of a legal guardian.

Sellers on the Platform are fully responsible for the accuracy and truthfulness of their product listings. This includes ensuring that all product descriptions, images, prices, and availability details are correct. Sellers must also handle the proper packaging, shipping, and delivery of products in compliance with applicable laws. Buyers, on the other hand, are responsible for reading listings thoroughly before making a purchase, and for ensuring their payment and delivery details are valid. The Service Provider is not liable for any disputes, product quality issues, miscommunication, or delivery problems that arise directly between buyers and sellers.

The Platform may not be used for any unlawful or harmful activities. Users are prohibited from engaging in illegal transactions, violating intellectual property laws, sharing misleading or harmful content, interfering with the experience of other users, or attempting to gain unauthorized access to the Platform or its systems. Any such activity may result in immediate suspension or permanent termination of the user’s account without prior notice.

All intellectual property rights associated with the Platform, including trademarks, logos, images, and underlying code, are the exclusive property of the Service Provider or its licensors. Users are not permitted to copy, alter, distribute, or create derivative works based on the Platform without prior written authorization from the Service Provider.

The Service Provider retains the right to modify, update, or discontinue the Platform or any of its features at any time. Users are expected to accept and install updates as they become available in order to continue using the Platform. Tampering with the Platform, including attempts to reverse-engineer the code or jailbreaking or rooting your device, is strictly prohibited and may compromise your device’s security and the proper functioning of the application.

The Platform uses various third-party services to support functionality, payments, analytics, and communications. These services include but are not limited to Google Play Services, AdMob, Google Analytics for Firebase, Firebase Crashlytics, Facebook SDK, One Signal, Sentry, Mixpanel, Razorpay, Stripe, Delhivery, and Shiprocket. Each third-party service operates under its own Terms and Conditions, and the Service Provider is not responsible for the data handling or operational practices of these third-party services.

A stable internet connection is required to use many features of the Platform. The Service Provider is not responsible for performance issues or limitations that may arise due to poor connectivity, limited mobile data, or restrictions placed by your internet service provider or mobile carrier. Users are responsible for any charges incurred due to data usage, including roaming charges when using the Platform outside their home region.

The Service Provider offers the Platform “as is” without guarantees of uninterrupted or error-free functionality. While efforts are made to ensure accuracy and reliability, the Platform depends on external contributors, including sellers and service providers, whose data may not always be accurate or timely. As such, the Service Provider does not accept liability for direct or indirect losses resulting from reliance on content or services accessed through the Platform.

Disputes between users are expected to be resolved by the parties involved. Although the Service Provider may offer tools or support to assist in resolving issues, it does not guarantee resolution or take responsibility for transaction outcomes between independent users.

The Service Provider reserves the right to suspend or terminate user accounts at any time for violations of these terms or suspicious activity. Upon termination, users must cease all use of the Platform and delete any copies stored on their devices. All rights and permissions granted under these Terms and Conditions will be immediately revoked.

These Terms and Conditions may be updated from time to time. When updates are made, the revised version will be published on this page. Continued use of the Platform following the publication of changes constitutes your acceptance of the revised terms.

This agreement is governed by the laws of India. Any disputes arising from the use of the Platform will fall under the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala, unless otherwise stated by applicable law.
